Information document pursuant to Articles 13-14 of the GDPR (General Data Protection Regulation) 2016/679

In compliance with EU Regulation 679/16 (GDPR), we provide you with the necessary information regarding the processing of the personal data you have provided. This privacy policy does not apply to other websites that may be accessed via links on the data controller’s domain websites, as the controller is not responsible in any way for third-party websites.

1) Data controller, processor, and place of processing

THE "DATA CONTROLLER"

Following the consultation of this website, data relating to identified or identifiable individuals may be processed. The “data controller” is ITANE IBERICA BUSINESS DEVELOPMENTS S.L., with its registered and operational office at PS DE GRACIA NUM.95 P.5 PTA.1 BARCELONA 08008 and N.I.F. B70665922. The “data processor” is Mr. Massimiliano Patané, located at the administrative headquarters of the same company.

PLACE OF DATA PROCESSING

The processing related to the web services of this site takes place at the aforementioned headquarters of the data controller and is handled only by personnel expressly appointed as data processors and/or authorized personnel, or by individuals responsible for occasional maintenance operations.

No data derived from the web service is communicated or disseminated.

The personal data provided by users who request informational material and/or quotes are used solely to perform the requested service and are communicated to third parties only when necessary for this purpose (e.g., shipping service, etc.).

2) Types of data processed

PERSONAL AND BROWSING DATA

A “PERSONAL DATA” is defined as any information relating to an identified or identifiable natural person (“data subject”); a natural person is considered identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.

BROWSING DATA​

The computer systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.

These are information that are not collected to be associated with identified data subjects, but which, by their very nature, could, through processing and association with data held by third parties, allow users to be identified.

This category of data includes IP addresses or domain names of the computers used by users who connect to the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the server’s response (successful, error, etc.), and other parameters related to the user’s operating system and IT environment.

DATA PROVIDED VOLUNTARILY BY THE USER

The optional, explicit, and voluntary sending of emails to the addresses indicated on this site and/or the completion of data collection forms entails the subsequent acquisition of the sender’s address, which is necessary to respond to requests, as well as any other personal data included.

3) Purposes of processing for which consent is granted where required (Art. 6 GDPR)

A)

The personal data voluntarily provided will be processed for the following purposes:
  • browsing this website;
  • filling out data collection forms for quote requests and/or contacts and/or job applications;
  • filling out data collection forms for online booking;
  • general administrative and accounting activities.

For the purposes of applying personal data protection regulations, processing carried out for administrative and accounting purposes includes activities related to organizational, administrative, financial, and accounting tasks, regardless of the nature of the processed data. Specifically, these purposes include internal organizational activities, those necessary for fulfilling contractual and pre-contractual obligations, and informational activities.

B)

The personal data provided when filling out data collection forms on websites or other data collection forms (such as name, surname, and email address) will be processed, with prior consent, by the Data Controller and Data Processors for promotional, commercial, and newsletter activities via email.

4) Processing Methods – Storage

The processing will be carried out both automatically and manually, using methods and tools designed to ensure maximum security and confidentiality, by personnel specifically appointed in compliance with Articles 13-14 of the GDPR.

Data will be retained for no longer than necessary for the purposes for which they were collected and subsequently processed.

5) Scope of Communication and Disclosure

Your data, subject to processing, will not be disclosed and may be communicated to companies contractually linked to ITANE IBERICA BUSINESS DEVELOPMENTS S.L. in order to fulfill contracts or related purposes. Data may be communicated to third parties belonging to the following categories:
  • entities providing services for the management of the IT system used by ITANE IBERICA BUSINESS DEVELOPMENTS S.L. and telecommunications networks;
  • firms or companies providing assistance and consultancy services;
  • competent authorities for compliance with legal obligations and/or provisions of public bodies, upon request.
Entities belonging to the above categories act as Data Processors or operate independently as separate Data Controllers. Any further communication or disclosure will only take place with your explicit consent.

6) Nature of Data Provision and Refusal

Apart from what is specified for browsing data, the user is free to provide personal data.

The provision of data for the purposes outlined in point A) is necessary. Failure to provide data for the purposes in point A) will result in the inability to obtain the requested services or to use the services of the Data Controller.

Consent for data processing for the purposes outlined in point B) is optional.

Refusal to provide consent for the purposes outlined in point B) will not have any negative consequences for the purposes outlined in point A).

7) Rights of Data Subjects

You may exercise your rights as expressed in Articles 12-23 by contacting the Data Controller or the Data Processor at our headquarters by calling +39 0331 15 27 081 or by sending an email to info@pec.itaneiberica.es. As a data subject, you have the rights outlined in Article 15 of the GDPR, specifically the right to:
  • Obtain confirmation of whether personal data concerning you exists, even if not yet recorded, and receive communication of such data in an intelligible form;
  • Obtain the following information:
    • a) The origin of the personal data;
    • b) The purposes and methods of processing;
    • c) The logic applied in case of processing carried out with the aid of electronic tools;
    • d) The identification details of the Data Controller, Data Processors, and the designated representative pursuant to Article 5(2) of the Privacy Code and Article 3(1) of the GDPR;
    • e) The entities or categories of entities to whom personal data may be communicated or who may become aware of it as designated representatives in the State’s territory, as data processors, or as authorized personnel;
  • Obtain:
    • The updating, rectification, or integration of data;
    • The erasure, anonymization, or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which it was collected or subsequently processed;
    • Confirmation that the actions described in points a) and b) have been communicated to those to whom the data has been disclosed or disseminated, except where such communication is impossible or requires a manifestly disproportionate effort compared to the right being protected;
  • Object, in whole or in part:
    • a) On legitimate grounds, to the processing of personal data concerning you, even if relevant to the purpose of collection;
    • b) To the processing of personal data concerning you for sending advertising materials, direct sales, market research, or commercial communications via automated calling systems without operator intervention, email, and/or traditional marketing methods such as telephone and/or postal mail.
Where applicable, you also have the rights under Articles 16-21 of the GDPR (Right to rectification, Right to erasure, Right to restriction of processing, Right to data portability, Right to object), as well as the right to lodge a complaint with the Supervisory Authority. At any time, you may obtain confirmation of the existence or non-existence of personal data concerning you, receive communication of such data and the purposes of processing, request the erasure, anonymization, or blocking of data processed unlawfully, as well as the updating, rectification, or, where you have an interest, the integration of the data. You may also object, on legitimate grounds, to the processing of your data.

8) Changes to the Privacy Policy

The Data Controller reserves the right to modify, update, add, or remove parts of this Privacy Policy at its sole discretion and at any time.

The data subject is responsible for periodically checking for any changes.

To facilitate this verification, this policy includes the date of its last update, which can be found on this page before the beginning of the policy.

Use of the website after the publication of changes will constitute acceptance of those changes.
